Kyrgyz Republic: Work Permit Annual Quotas Set

KYRGYZ REPUBLIC: Work Permit Annual Quotas Set By The Government of The Kyrgyz Republic.

Work Permit applications must be made in December or January.

Companies who are planning to send employees on assignment to the Kyrgyz Republic are subject to the Kyrgyz Republic’s foreign labor laws and must obtain a permit by an authorized agency in charge of migration issues. The employee entering the Kyrgyz Republic temporarily for work purposes must also apply for a Work Permit.

The government is currently setting annual quotas and if application is not made in time, it is possible the quota will be full and Work Permits will no longer be available. The process for application can take 45 to 60 days.

Note that the employer contributes funds which are established by the government in order to cover an employee’s travel. Annually, national interests and the domestic labor market are taken into consideration and a quota is set for foreign travel. The authorized public agency in charge of migration issues takes into account these contributions and distributes accordingly prioritizing the vacant jobs of the nationals of the Kyrgyz Republic.

BELGIUM: Medical Certificate Abolished for Purposes of Residency

Effective December 1, 2008, the Belgian Minister of Migration implemented a new rule stating that employees with work permits no longer need to provide a medical certificate when applying for a Type D visa application. The same exception pertains to work-permit holders entering Belgium that do not apply for a visa with consular authorities abroad.

Certain foreign employees, however, who enter Belgium for a maximum 6-month stay are exempt from this new regulation and include, but are not limited to, specialized technicians, such as assemblers or installers of foreign-built machines; nor is it relevant to foreign employees who are exempt from holding work permits.

This information provided to you by PLG KGNM Belgium.

Local Residence Process Changes Effective Immediately

All foreign nationals are required to register their residence or accommodation within 24 hours of arrival in Shanghai.

All foreigners in Shanghai who visited the Shanghai Public Security Bureau before the 1st of December 2008 need to re-register and obtain new Temporary Residence Registration forms.

This is a follow up to a previous Global Brief, where Pro-link GLOBAL advised that on 1st October 2008, the Shanghai Public Security Bureau would issue a new Temporary Residence Registration Form for foreign nationals, replacing the prior version of the form.

This form has been released and all foreign national visitors and residents in Shanghai, including Hong Kong, Taiwan and Macau passport holders, are required to complete temporary residence registration at the local police stations using the new form.

Please note that those clients who change residences in Shanghai must have their residence permits amended at the Shanghai Exit-Entry Administration Bureau in Pudong within 10 days of obtaining a new Temporary Residence Registration Form.

We have been advised that registration processes may vary across local police stations or managing offices, it is best to check with your local area police station to confirm their specific requirements.

The general documents may include:

- Original and copy of passport;
- Original and copy of lease agreement (or property title certificate);
- Copy of lessee's ID card; and,
- New registration form - The form will either be a pink paper or white A4 paper which has a sequence number with a quadrate stamp.
Please note that the foreign national may have to file the registration report in person, however generally this is not required. This Global BRIEF alert is provided for your information only.
